Terms Of Use

Before you can subscribe to our web services, you must agree to our Terms Of Use. A physcial copy which you can keep will be provided with the agreement you sign when purchasing our services.

1. General Conditions

illuminateWeb is the trading name of the web service delivery operations of illuminateICT.

Payments and Cancellations

illuminateWeb will bill customers on a yearly cycle, the anniversary date being determined from the hosting start date shown on your contract. Prompt payment is necessary to ensure uninterrupted service of your account.
 
Customers will be billed in the eleventh month of their service in order to ensure uninterrupted service. Please pay this within 30 days of the invoice date. Failure to do so may result in the service being suspended or cancelled without additional notice.  Should you wish to cancel your service you can do so at any point provided 30 days notice is given in writing from an authorised party (the same person who signed the original contract or their organisation's superior). We cannot refund for periods already paid for, and hosting will always be charged in advance. For instance, if you cancel on month six you will have still paid for a full year and no refund will be due.  

Ethical Policy (Content Restriction)

illuminateWeb have agreed to operate to an ethos of not working with or promoting certain classes of business (commercial, non-profit and 'think-tank'). This is an agreed policy and is not for dispute by our customers. We refuse to work with, and by implication promote or assist the following ventures (although this list is by no means exclusive):

  • Any party operating illegally or undertaking illegal activities under current UK law
  • Those involved producing, selling, or promoting (in any way) pornography, alcohol and tobacco use, narcotics (non prescription medicines and prescribed medicines used in ways they are not prescribed for), weapons and mechanisms for war, terrorism or other physical or mental harm. All of these are regardless of their legality under UK law
  • Promotion of products from the pharmaceutical, nuclear, chemical and biological industries (and those connected with them
  • Political campaigning and promotion
  • Any money making scheme, sales or service (without prior written approval from illuminateWeb)

The use of illuminateWeb's services to store, post, display, transmit, advertise or otherwise make available any of the above is prohibited. We reserve the right to terminate your service, without notice or refund, should this be violated. illuminateWeb will act as the sole arbiter in these matters. In addition where appropriate we reserve the right to notify law enforcement agencies and assist their investigations.

Resale

illuminateWeb is pleased to accept customer referrals, and much of our work comes from this. However, we do not allow anybody (apart from our authorised franchises) to sell on our services, or websites (including parts of) created and/or hosted by us. This includes denying our customers from selling any work they may do or using our services to a third party. Any exceptions to this will require written permission from illuminateWeb.

Disclaimer

illuminateWeb has taken the greatest of care to ensure the accuracy of the contents of our websites and documentation. We cannot however accept responsibility for any inaccuracies, omissions, or errors; whether in respect of the information provided, or to which we may link or signpost our customers to.

  

2. Hosting Conditions

(As dictated by our hosting company)

Upon signing up for illuminateWeb's services, all customers agree to comply with illuminateWeb's Terms of Use (“TOU”). The spirit of the TOU is to ensure customers are using the services with due regard to the rights of other Internet users and in conformity with the requirements of the hosting company's network environment. These TOU are not exhaustive and the right to add, delete, or modify these TOU at any time without notice is reserved. Modified TOU will be made available on our website.  Any complaints about a customer’s violation of the TOU should be sent to team@illuminateict.org.uk
 
Actions that May be Taken
The failure by a customer to meet or follow any of the Terms of Use (TOU) is grounds for account deactivation. illuminateWeb (here-on may be referred to as "we") and/or it's authorised agents will be the sole arbiter as to what constitutes a violation of the TOU. We also reserve the right to remove any account without prior notice. When we become aware of an alleged violation of its TOU, we will initiate an investigation. During the investigation, we may restrict a customer's access in order to prevent further potentially unauthorised activity. Depending on the severity of the violation, we may, at its sole discretion, restrict, suspend or terminate a customer's web hosting account and/or pursue other civil remedies. If such violation is a criminal offence, we will notify the appropriate law enforcement authorities of such violation. We do not issue credits, or partial refunds, for outages incurred through service disablement resulting from TOU violations. illuminateWeb customers agree to indemnify and hold harmless illuminateWeb from any claims resulting from the use of our services that damages them or any other party. The illuminaetWeb service is provided on an as-is-available basis without warranties of any kind, either express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose or non-infringement. We expressly disclaim any representation or warranty that the illuminaetWeb service will be error-free, secure or uninterrupted. No oral advice or written information given by illuminateWeb, its employees, licensers or the like, will create a warranty; nor may you rely on any such information or advice. illuminateWeb and its partners and suppliers will not be liable for any cost or damage arising either directly or indirectly from any transaction or use of the service.
 
Backup/Recovery
If a loss of data stored on illuminateWeb's server occurs whilst using our services and is deemed that a loss of data is the fault of us, or our hosting provider, either we or our hosting partner will provide cost free backup and data recovery for lost data up until the last differential available. illuminateWeb, and our chosen hosting partner(s), shall be the sole arbiters of the cause of the data loss. If the cause of the data loss is the fault of the customer will reserve the right to charge for data recovery.
 
Copyright Violations
The Digital Millennium Copyright Act ("DMCA") sets forth the requirements for valid copyright infringement notification. If you would like to notify illuminateWeb of an infringement of your copyright, the DMCA requires that you send your notification to us via:

  • the 'Contact Us' form on our illuminateWeb website
  • emailing the team@illuminateict.org.uk
  • post to our registered address: illuminateICT c/o WAYC, Jubilee House, Westlea Road, Leamington Spa, CV31 3JE

Include in your notification the following information:

a. A physical or electronic signature of the copyright owner or a person authorised to act on the copyright owner's behalf (the "Claimant")
b. Identification of the copyrighted work(s) claimed to have been infringed
c. Identification of the material claimed to infringe the copyright(s), and enough information for illuminateWeb to locate it
d. The Claimant's name, address, and telephone number(s)
e. A statement that the Claimant has a good faith belief that use of the disputed material is not authorised by the copyright owner or his agent
f. A statement, under penalty of perjury, that the information in the notification of copyright infringement is accurate and that the Claimant is authorised to act on behalf of the copyright owner.

Customer Responsibility
Customers are required to use the illuminateWeb's network responsibly. This includes respecting our other web customers. We reserve the right to suspend and/or cancel services with any customer who uses our network in such a way that adversely affects our other customers. While we may monitor our services electronically to determine that our facilities are operating satisfactorily, as a general practice, we do not monitor our customers' communications or activities to determine whether they are in compliance with the TOU. However, when we becomes aware of any violation of the TOU or other user agreements, we may take any action to stop or correct such violation, including, but not limited to, denying access to illuminateWeb's services and equipment. In addition, we may take action against a customer or their agents, or those acting on their behalf, due to their activities. We anticipate that customers using our services will cooperate with us in any corrective or preventive action that we may deem necessary. Failure to cooperate with such corrective or preventive measures is a violation of illuminateWeb's policy and we reserve the right to take any such action even though such action may affect other customers, agents, or people working on behalf of our customer.
 
Illegal Use
illuminateWeb services may be used for lawful purposes only. Transmission, storage or distribution of any information, data or material in violation of any applicable law or regulation, or that may directly facilitate the violation of any particular law or regulation, is prohibited. This includes, but is not limited to: copyrighted material; trademarks; trade secrets or other intellectual property rights used without proper authorisation; material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws. Examples of unacceptable content or links include: pirated software; hacker programs, scripts or source code; warez sites; copyright text, images, audio or video (without written proof of consent from the copyright holder); and/or any other form of Intellectual Property which the party posting the information doesn't have the legal authority to do.
 
Modification
illuminateWeb, and our chosen hosting provider, reserve the right to add, delete or modify any provision of its Terms of Use at any time without notice.
 
Privacy
illuminateWeb is concerned with the privacy of on-line communications and web sites. In general, the Internet is neither more nor less secure than other means of communication, including mail, facsimile, and voice telephone service, all of which can be intercepted and otherwise compromised. As a matter of prudence, however, we urge our customers to assume that all of their on-line communications are insecure. We cannot take any responsibility for the security of information transmitted over, or using, our facilities.
 
Server and System Abuse
Violations of system or network security are prohibited and may result in criminal and civil liability. Examples of system or network security violations include, without limitation the following: unauthorized access to or use of data, systems or networks, including any attempt to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without express authorization of the owner of the system or network; interference with service to any user, host or network including, without limitation, mail bombing, flooding, deliberate attempts to overload a system and broadcast attacks; forging of any TCP/IP packet header or any part of the header information in an email or a newsgroup posting.
 
Service Limitations
illuminateWeb, our partners, agents and related persons, shall not be held liable for any consequential, indirect, special, punitive, or incidental damages, whether foreseeable or unforeseeable, based on claims of the customer or its customers, (including but not limited to, claims for loss of data, goodwill, profits, use of money or use of the software, interruption in use or availability of data, stoppage of other work or impairment of other assets), arising out of breach of implied warranty, breach of contract, misrepresentation, negligence, strict liability in tort or otherwise, except only in the case of personal injury where and to the extent that applicable law prohibits exclusion of such liability. In no event will the aggregate liability which illuminateWeb, our partners, agents and related persons, may incur in any action or proceeding arising out of performance or non-performance of this agreement exceed the total amount actually paid to illuminateWeb by the customer for the specific product or service that directly caused the damage.

Traffic/Bandwidth Usage
Customers using over their agreed monthly bandwidth allocation (calculated in GB), whilst using ours services may be subject to an additional charge. Bandwidth will be calculated as an average across the calendar month, and will factor in current and expected annual use. If you expect to use over your agreed bandwidth allocation you should approach us to purchase additional allocation.
 
Spam (Unsolicited Commerce Email)
Spamming, the sending of unsolicited mass email from or through an illuminateWeb server/service is STRICTLY prohibited. illuminateWeb will be the sole arbiter as to what constitutes a violation of this provision. Customers are also in violation of this provision if they engage in spamming using the service of another ISP or IPP, but reference in the spam a website hosted on an illuminateWeb server, or if they sell or distribute software on their website that facilitates spamming. Violators will be assessed by illuminateWeb and reserve the right to impose immediate suspension of their services with no refund.
 
Please report any instances of spamming through the use of illuminateWeb's services to team@illuminateict.org.uk . You should provide as much information as possible and clearly identifying the source of the unsolicited email. This will then be investigated, dealt with and replied to with due haste.

Viruses and Other Destructive Activities
Use of illuminateWeb's services or equipment for creating or sending Internet viruses, worms or Trojan horses, or for pinging, flooding or mail bombing, or engaging in denial of service attacks is prohibited. It is also prohibited for any customer to engage in other activity that is intended to disrupt or interfere with, or that results in the disruption of or interference with, the ability of others to effectively use our services and equipment (or any connected network, system, service or equipment) or conduct their business over the Internet.
